Event begins with a 2 PM SMOKE SESH. The guided painting activity begins promptly at 2:20 PM and ends at 4:20 PM. PUFF & PAINT materials are included in the price of admission. Bring your creative side, and we’ll provide the good vibes!

PARTICIPANT LIABILITY WAIVER AND RELEASE OF CLAIMS

This Waiver and Release of Liability Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”), in consideration for being permitted to participate in the BudCrawlUSA Sip & Paint event (the “Event”) organized by GrubCrawlUSA.com (“Organizer”), and held at a venue disclosed at the time of ticket purchase or upon arrival.

1. ASSUMPTION OF RISK: Participant acknowledges and agrees that participation in the Event is voluntary and involves inherent risks, including but not limited to exposure to cannabis and cannabis products, interaction with other attendees who may be consuming cannabis legally in accordance with California state law, and other risks associated with group events and social gatherings. Participant affirms that they are at least 21 years of age and are participating with full knowledge and acceptance of these risks.

2. RELEASE AND WAIVER OF LIABILITY: Participant, on behalf of themselves, their heirs, executors, administrators, assigns, and legal representatives, hereby fully and forever releases, waives, discharges, and covenants not to sue the following parties:

  • GrubCrawlUSA.com (Organizer),
  • Cline Moore, the designated EMCEE,
  • The owners and operators of the event location,
  • Any and all contractors, employees, and agents engaged by the Organizer to support the Event, including but not limited to individuals referred to as “Ambassadors,”

from any and all claims, liabilities, demands, actions, causes of action, costs, damages, or losses arising out of or related to participation in the Event, including but not limited to claims related to personal injury, illness, property damage, or death, even if caused by negligence.

3. INDEMNIFICATION: Participant agrees to indemnify, defend, and hold harmless the above-listed Released Parties from any and all losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) incurred as a result of any claim or legal proceeding brought by or on behalf of Participant, or any third party, arising out of Participant’s conduct or participation in the Event.

4. CANNABIS ACKNOWLEDGEMENT: Participant acknowledges that cannabis and cannabis-related products may be legally consumed on or near the premises by individuals in accordance with California law. Participant assumes all risks associated with exposure to cannabis and agrees that Organizer and Released Parties shall not be liable for any injury, health issues, or other consequences resulting from such exposure.

5. MEDICAL CONDITION: Participant represents that they are in good health and have no medical or physical condition that would endanger themselves or others in connection with the Event. If Participant has any medical condition that may be affected by the consumption of cannabis (direct or secondhand exposure), it is their responsibility to take necessary precautions.

6. BINDING AGREEMENT: This Agreement shall be binding upon the Participant and their successors, assigns, heirs, and legal representatives. This Agreement shall be construed in accordance with and governed by the laws of the State of California. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. AGREEMENT TO TERMS: By completing the purchase of a ticket to the Event, whether online or at the door, or by attending the Event in any capacity, Participant affirms that they have read, understand, and voluntarily agree to be bound by the terms of this Agreement. This Agreement may be electronically signed or acknowledged via ticketing platform and shall be enforceable as an original document.

For tickets purchased online, this waiver is considered signed upon ticket confirmation. For tickets purchased at the door, participants must sign a printed version of this form prior to entry.
